Welcome to AbsoluteClarityAutoGlass.com (the “Site” or “Platform”), operated by Absolute Clarity Auto Glass LLC (“Absolute Clarity Auto Glass,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our Site and services, which include connecting customers (“you,” “your,” or “User”) with third-party auto glass installation and repair service providers (“Installers”), and facilitating the scheduling, paperwork, and payment processing for such services (collectively, the “Services”).

By accessing or using our Site and Services, you agree to be bound by these Terms and our Privacy Policy (please insert a link to your Privacy Policy here when available), which is incorporated by reference into these Terms. If you do not agree to all of these Terms, do not access or use our Site or Services.

1. Our Role and Services

Absolute Clarity Auto Glass acts as an intermediary platform. Our Services consist of:

• Providing information about auto glass services.
• Facilitating your requests for quotes for auto glass repair or replacement.
• Connecting you with qualified independent third-party Installers.
• Assisting with the processing of insurance or warranty claims paperwork required for your auto glass service.
• Scheduling appointments between you and Installers.
• Processing payments for the services rendered by Installers.

IMPORTANT: Absolute Clarity Auto Glass does not perform auto glass installations or repairs. The Installers are independent contractors and are not employees, agents, or subcontractors of Absolute Clarity Auto Glass. We are not responsible for the conduct, quality of work, warranties, or any liabilities associated with the services provided by the Installers. Any claims related to the installation, repair, or warranty of the auto glass work itself must be directed to the respective Installer.

2. User Obligations and Account Information

• Accurate Information: You agree to provide accurate, current, and complete information when requesting quotes, scheduling services, or otherwise using our Platform. This includes, but is not limited to, your name, contact information, vehicle make, model, year, Vehicle Identification Number (VIN), specific glass damage details, and insurance/warranty information. The accuracy of this information is imperative for receiving an accurate quote and for the Installer to perform the service correctly. We are not responsible for issues arising from inaccurate or incomplete information provided by you.
• No User Accounts: Currently, user accounts are not required to use our Services. We will store and track your information through our internal portal to facilitate current and future service requests as outlined in our Privacy Policy.
• Lawful Use: You agree to use the Site and Services only for lawful purposes and in accordance with these Terms.

3. Quotes, Service Requests, and Scheduling

• Quotes: Quotes provided through our Site are based on the information you provide and, for insurance/warranty claims, on approval from your insurance/warranty provider. Quotes for out-of-pocket expenses are subject to confirmation based on the accuracy of this information.
• Service Availability: Services are subject to the availability of Installers in your area.
• Communication Consent: By using our Services, you consent to be contacted by Absolute Clarity Auto Glass and the assigned Installer via email, phone, or SMS text messages for purposes related to your service requests, scheduling, payment, and follow-up communications. Standard message and data rates may apply.
• Cancellation and Rescheduling:
  • Out-of-Pocket Services:
    • Cancellation by User: If you cancel an out-of-pocket service after booking, you will be eligible for a seventy-five percent (75%) refund of the amount paid.
    • Rescheduling by User: The first reschedule for an out-of-pocket service is free of charge. Subsequent reschedules will incur a $25.00 fee per instance.
  • Insurance/Warranty Claim Services: There is no charge for cancelling or rescheduling services covered by an approved insurance or warranty claim.
  • Cancellation/Rescheduling by Installer or Us: If an Installer or Absolute Clarity Auto Glass needs to cancel or reschedule your appointment, we will notify you as soon as possible to arrange a new appointment.
• Access to Vehicle: You are responsible for ensuring the assigned Installer has safe and timely access to your vehicle at the scheduled appointment time and location.

4. Payment Terms

• Out-of-Pocket Services: Payment for out-of-pocket services is due in full at the time of booking.
• Insurance/Warranty Claim Services: Payment for services covered by an approved insurance or warranty claim will be processed by us after the service has been completed by the Installer, in accordance with the terms of your insurance/warranty provider. You are responsible for any deductibles, co-pays, or amounts not covered by your insurance/warranty provider.
• Payment Processing: We facilitate payment processing for the services rendered by Installers. You authorize us to charge your chosen payment method for the amounts due.
• Refunds for Service Issues: Absolute Clarity Auto Glass does not provide refunds for issues related to the quality of installation, materials used, or damage allegedly caused by an Installer. All Installers warranty their own work. Any claims for refunds or adjustments due to service quality must be made directly to the Installer who performed the service, in accordance with their warranty and policies.

5. Third-Party Installers

• Selection: We check for certifications for Installers within our network. Installers are independent, stand-alone businesses responsible for their own compliance with applicable laws and regulations.
• No Endorsement: While we facilitate connections, your engagement with an Installer is at your own risk. We do not endorse, guarantee, or control the quality, timing, legality, or any other aspect of the services provided by Installers.
• Warranty by Installer: All auto glass installation and repair services are warranted directly by the Installer who performs the service, not by Absolute Clarity Auto Glass. You will receive warranty information directly from the Installer. All warranty claims must be made directly to the Installer.
• Disputes with Installers: Any disputes, claims for damages, or issues related to the actual auto glass work performed (including, but not limited to, quality of workmanship, materials used, damage to your vehicle during installation, or warranty issues) must be resolved directly between you and the Installer. Absolute Clarity Auto Glass has no obligation to mediate or resolve such disputes.
• Release of Liability for Installer Services: By using our Services, you expressly release Absolute Clarity Auto Glass, its officers, directors, employees, and agents from any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with the services performed by or any act or omission of any Installer.

6. Intellectual Property

• The Site, its content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Absolute Clarity Auto Glass, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
• These Terms permit you to use the Site for your personal, non-commercial use only in connection with obtaining our Services. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as incidentally necessary to use the Services.
• The technology and platform (portal) used to provide and manage these services may be owned by third-party licensors (e.g., AutoOps.co). Your use of our Site is subject to these Terms, and you acquire no rights to such underlying technology except as specifically permitted to access our Services.

7. Privacy

Your use of our Site and Services is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices regarding your personal information and how we share information with Installers to facilitate the Services.

8. Disclaimer of Warranties (for Absolute Clarity Auto Glass’s Platform)

THE SITE AND OUR SERVICES (AS AN INTERMEDIARY PLATFORM) ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. NEITHER ABSOLUTE CLARITY AUTO GLASS NOR ANY PERSON ASSOCIATED WITH US MAKES ANY WARRANTY OR REPRESENTATION WITH RESPECT TO THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE OR OUR INTERMEDIARY SERVICES. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT THE SITE OR OUR SERVICES WILL BE ACCURATE, RELIABLE, ERROR-FREE, OR UNINTERRUPTED, THAT DEFECTS WILL BE CORRECTED, THAT OUR SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

THIS SECTION DOES NOT AFFECT ANY WARRANTIES ON THE ACTUAL AUTO GLASS WORK, WHICH ARE PROVIDED DIRECTLY BY THE INSTALLERS.

9. Limitation of Liability (for Absolute Clarity Auto Glass’s Platform)

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO EVENT WILL ABSOLUTE CLARITY AUTO GLASS, ITS AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, OUR SITE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE SITE, OR OUR INTERMEDIARY SERVICES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT, OR OTHERWISE, EVEN IF FORESEEABLE.

OUR LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO US FOR OUR SPECIFIC INTERMEDIARY SERVICES GIVING RISE TO THE CLAIM.

THIS LIMITATION OF LIABILITY DOES NOT APPLY TO LIABILITY RESULTING FROM OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT. IT ALSO DOES NOT LIMIT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (SUCH AS LIABILITY FOR THE INSTALLER’S WORK, WHICH IS THE INSTALLER’S RESPONSIBILITY).

10. Indemnification

You agree to defend, indemnify, and hold harmless Absolute Clarity Auto Glass, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms or your use of the Site or Services, including, but not limited to, any use of the Site’s content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Site, or your interactions or disputes with Installers.

11. Governing Law and Dispute Resolution (for disputes involving Absolute Clarity Auto Glass)

These Terms and any dispute or claim arising out of, or related to, them, their subject matter, or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Wyoming without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site or our intermediary Services shall be instituted exclusively in the federal courts of the United States or the courts of the State of Wyoming. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

12. Changes to Terms and Conditions

We reserve the right, in our sole discretion, to revise and update these Terms from time to time. All changes are effective immediately when we post them and apply to all access to and use of the Site and Services thereafter. Your continued use of the Site or Services following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page frequently so you are aware of any changes, as they are binding on you.

13. Termination

We may terminate or suspend your access to all or part of the Site or Services for any or no reason, including without limitation, any violation of these Terms.

14. Entire Agreement

These Terms and our Privacy Policy constitute the sole and entire agreement between you and Absolute Clarity Auto Glass regarding the Site and our intermediary Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site and Services.
